These Terms of Service ("Terms") govern your use of the Macalicious Shopify store at macaliciousbaking.com, Macalicious products, and Macalicious in the Kitchen. Macalicious Baking Company, Macalicious, and Macalicious in the Kitchen are referred to in these Terms as "Macalicious," "we," "us," or "our."

Acceptance of Terms

By visiting our store, placing an order, creating an account, using Macalicious in the Kitchen, joining an email or SMS program, or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services.

Eligibility

You must be at least 18 years old, or have permission from a parent or guardian, to purchase products or use features that require an account, phone number, or payment information.

Products, Orders, and Pricing

Macalicious sells DIY baking kits, baking accessories, digital or app-supported baking resources, and related products. Product descriptions, contents, availability, pricing, promotions, and shipping estimates may change without notice.

We may correct errors, update information, cancel orders, limit quantities, or refuse service where needed, including after an order is submitted.

By placing an order, you agree to provide accurate billing, shipping, and contact information and to keep your information current so we can fulfill and support your order.

Shipping, Returns, and Refunds

Shipping timelines are estimates and may be affected by carrier delays, weather, inventory timing, address issues, or other events outside our control.

Returns, refunds, replacements, and exchanges are handled according to our posted Returns page and any product-specific instructions. Because food-related products and DIY kits may contain consumable items, some items may be non-returnable once shipped, opened, used, or otherwise ineligible under our policy.

Macalicious in the Kitchen App

Macalicious in the Kitchen provides guided baking instructions, timers, reminders, videos, written instructions, downloadable resources, and educational support for Macalicious baking projects.

The app is intended to help you bake with more confidence, but baking results depend on your environment, ingredients, equipment, timing, storage conditions, and personal execution. We do not guarantee a specific result, rise, texture, flavor, appearance, or baking outcome.

You agree not to misuse the app, interfere with the service, attempt unauthorized access, submit harmful code, scrape or copy app content for commercial use, or use the app for unlawful purposes.

Baking, Food Safety, and Allergen Notice

Macalicious products and instructions are provided for general home-baking use. You are responsible for following safe food handling practices, reading ingredient and allergen information, supervising children, using kitchen tools safely, and confirming that products are appropriate for your household.

Our products may contain or be processed around common allergens. Review product labels and packaging before use. If you have allergies, dietary restrictions, medical concerns, or food-safety questions, consult an appropriate professional before using the product.

Email and SMS Communications

By providing your email address or phone number, you agree that Macalicious may contact you about orders, account activity, customer support, app reminders, baking projects, and other service-related communications.

Marketing emails and marketing SMS messages are sent only where permitted and based on the consent flow or signup you use. Consent to receive SMS messages is not a condition of purchase.

SMS Terms: Macalicious in the Kitchen Alerts

Program names may include Macalicious in the Kitchen Alerts, Macalicious Alerts, and Macalicious Marketing.

Program description: Macalicious SMS programs may send baking timer reminders, recipe step prompts, app notifications, order or account updates, customer support follow-up, cart or checkout reminders, product announcements, promotions, offers, and other messages you request or agree to receive.

Opt-in: You may opt in by entering your phone number and submitting an SMS signup form, checking an SMS consent box, enabling SMS reminders in Macalicious in the Kitchen, confirming your number through an app flow, or otherwise completing a disclosed Macalicious SMS consent process.

Consent is not required to buy Macalicious products. Consent to receive SMS messages is not a condition of purchase.

Message frequency varies. Kitchen reminder frequency depends on the baking project, timers, steps, and reminder settings you choose. Marketing message frequency may vary based on campaigns, promotions, launches, and your signup preferences.

Message and data rates may apply. Message delivery depends on your wireless carrier and device and is not guaranteed.

To stop receiving SMS messages, reply STOP. After you reply STOP, we may send one final confirmation message. After that, we will not send further SMS messages to that number unless you opt in again.

Supported carriers are not liable for delayed or undelivered messages. You are responsible for charges from your mobile carrier.

SMS privacy practices are described in our Privacy Policy, including our commitment that mobile information, mobile opt-in information, and SMS consent data are not sold or shared with third parties or affiliates for their own marketing or promotional purposes.

User Content and Community Features

If you submit reviews, photos, comments, community posts, support messages, or other content, you represent that you have the right to share it and that it does not violate the rights of others.

You grant Macalicious a non-exclusive right to use content you submit to operate, improve, promote, and support our products and services, subject to our Privacy Policy and applicable law.

Intellectual Property

Macalicious names, logos, designs, recipes, videos, written instructions, downloadable resources, product packaging, app content, site content, photos, graphics, text, and software are owned by or licensed to Macalicious and are protected by intellectual property laws.

You may use our content for personal, non-commercial baking use. You may not reproduce, distribute, modify, resell, publish, or commercially exploit our content without written permission.

Third-Party Services

Our store and app may rely on third-party platforms and providers, including Shopify, payment processors, shipping carriers, email providers, SMS providers such as Twilio, app hosting providers, analytics providers, and embedded media platforms. Their services may be governed by their own terms and policies.

No Warranty

Our services and products are provided to the fullest extent permitted by law on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free content, specific baking results, or that every feature will remain available.

Limitation of Liability

To the fullest extent permitted by law, Macalicious will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

To the fullest extent permitted by law, our total liability for a claim will not exceed the amount you paid for the product or service giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Macalicious from claims, liabilities, damages, losses, and expenses arising from your misuse of our services, violation of these Terms, violation of law, or infringement of another person's rights.

Governing Law

These Terms are governed by applicable United States law and applicable state consumer protection laws, without waiving rights that cannot be waived by contract.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new last-updated date. Your continued use of our services after an update means you accept the updated Terms.
